How it works.

  1. Free consultation. Call me. Tell me what happened. No cost, no obligation.
  2. Investigation. I gather the police report, photos, witness statements, and medical records. I find out what insurance is available — sometimes there is more coverage than the other side wants you to know about.
  3. Treatment. You focus on getting better. I handle the rest. I will help you find doctors if you do not have one.
  4. Demand. Once your treatment is complete or stable, I send a detailed demand to the insurance carrier laying out your damages and what your case is worth.
  5. Negotiation — or lawsuit. Most cases settle. The ones that do not settle, we file. I prepare every case as if it will go to trial because the cases that settle fairly are the ones where the other side knows you are ready.
  6. Resolution. When the case is over, I make sure the medical liens are properly handled and you keep as much of your settlement as the law allows.

Fees.

Personal injury cases are handled on a contingency fee. That means there is no fee unless we recover money for you. If we do recover, the fee is a percentage of the recovery. I will explain it clearly before you ever sign anything.

The time limit.

Tennessee generally requires a personal injury lawsuit to be filed within one year of the injury. Georgia gives you two. There are exceptions and complications. Do not wait until the deadline is close — evidence disappears, witnesses move, and your bargaining position weakens with every month.

Tenn. Code Ann. § 28-3-104 — Personal tort actions

Actions for injuries to the person, civil actions for compensatory or punitive damages, or both, brought under the federal civil rights statutes shall be commenced within one (1) year after the cause of action accrued.

O.C.G.A. § 9-3-33 — Georgia personal injury limitations

Actions for injuries to the person shall be brought within two (2) years after the right of action accrues.

Special rules apply for minors, claims against government entities (which have shorter notice requirements), wrongful death, and medical malpractice. Call before assuming any deadline.
